DOG KILLER IS A POLICE OFFICER !!!   [forward as email]

I have a friend who I met at one of our first shows and she helped me get started with the confidence to go out in the ring and try, unfortunatly SHE HAS HAD AN UNFORTUNATE TRAGEDY. Please help in her request or with any advice that you may have or any similar experiences. I do not believe that she is part of this board and that is why I am posting for her. Maria DeJesus <ybarrakennels@hotmail.com> I come forward to all owners of AmStaff's and or Am. Pit Bull Terriers...This past weekend I was at an Antioch show and came home Sunday night. Monday morning I let my dogs out of their kennels to run around and play I went in the house for a little while and I took a nap, my boyfriend stayed awake and watched over the dogs. Not even 2 minutes from him checkin on them and seeing them basking in the sun did he hear 3 gunshots. My boy Baloo,UKC Champion, CGC certified, and the pride and joy of my life is now gone, he was shot in or around his head and died instantly, the other dog was a dog I bred and was showing for my cousin at the Antioch show where he took 2 third placements, 1 fourth place, and he won one first place, also died of gunshot wounds to the chest. These dogs were in my neighbors yard, my neighbor knew that Baloo was my dog but he failed to INFORM ME of them being in his yard, so he called the East Palo Alto Police Department and informed them of Pit Bulls loose in his yard, NO ONE was hurt, NO ONE was bit, the officer went into the backyard to see where the dogs came out of when Baloo approached him he shot him point blank and killed him instantly, he said Baloo charged at him aggresively which myself and everyone that has been informed so far that knew this dog personally, KNOW he would NEVER harm anyone. The second dog Geyser was right behind him so the officer decided to shoot him as well, not shooting him once but twice in his chest he crawled back into my yard and died of his wounds. Louie the third dog that was there that day saved his own life by running back into my yard where I kenneled him immediately. This should have never happened. I know what occured falls on me as well. This neighbor has threatened me before and I have nothing but bad issues with my neighbors because of my breed of choice. I can not tell you or explain to you the pain of seeing your best friend lying there bleeding and dead, I can not tell you how much those images have gone through my head in the past 24 hours. My cousin was on his way to pick up his dog when this all happened. This officer didn't have to shoot my dogs and kill them. Baloo's body was facing my yard like he was trying to come back to my yard. Geyser was curled up with his eyes shut and an obvious look of pain. I can not tell you how much this has and is going to change my life I plane on moving from ther withtin the month I can't go home and not see Baloo there or see my neighbor who knew all he had to do was tell me my dogs were in his yard. This didn't have to end this way. I am extremely emotional right now and have been having my ups and downs as I try and decide where to go from here. These dogs were in a contained area they were not a threat to the public this officer decided to take it upon himself and kill my dogs instead of waiting for animal control or for my neighbor to just say hey they belong to her. It is devestating to see your dogs lying there lifeless, especially when it all could of been avoided. I am not going to let this police department sweep this under the rug. My cousin and I are going to press charges and go to the media for support. We are also going down to the Humane Society where the bodies of our dogs are and figure out what to do with them. We want to do necropsy to find out how far the dogs were from the officer and find out what direction the dogs were facing when the officer fired his gun. THIS COULD OF BEEN A LOT WORSE. My children could of been playing in the yard as they often do with the dogs and this trigger happy cop could of fired his gun the bullet could of easily traveled through a fence and hit anyone standing in my yard. THESE unecessary police officer shootings NEED TO STOP. Not just on animals but humans as well. Our SKIN is our SIN. The way my dogs look is why they are dead. Take this as a precaution. ANYONE That personally knew Baloo, please help me to fight this officer even if I don't win maybe it will make them think twice about fireing there weapon and maybe just maybe it will keep a tragedy like this from occuring again to another dog and family. I am in complete mourning of the loss of my boy he was an amazing dog and all who knew him knew his soul. I keep thinking this is some bad dream and I will wake up from it, but it is not, this is my reality and I must be strong and try and fight against the wrongful killing of them. This officer had many options other then to take it upon himself to kill them. PLEASE PLEASE ANYONE who knew Baloo personally write a statement do something to help me, maybe some of you know some people that can help me in this fight. Another question I keep pondering is WHY, WHY if my dogs were such a threat to the public and were aggressive WHY is Louie right here by my side. WHY didn't they quarentine him or evaluate his temperment????? I can ask a lot of WHY WHY WHY's and never get an answer. My dog is gone he can't be replaced he can't be brought back, but if I can do anything to make sure his death was NOT in VAIN, I sure in the hell am gonna give EPA Police a fight they ain't never seen before. Please keep me and my cousin and my dogs passed in your prayers and thoughts as we try to come to terms with our losses and try to stay strong for our breed in general and for the fight ahead of us. UPDATE I can use as much help as I can get from all of you Hello to everyone, So this past Friday I got the Police Report back. What a crock let me tell you. First of all right after all of this happened, the police said Baloo was the initiator in the ordeal. Now in the police report they are saying that Geyser was the initiator. I truly believe in my heart that they shot and killed Baloo first and then Geyser. I believe after they recieved Baloo's show champion certificate and his Canine Good Citizen Certificate that they changed there story around. I should not have released that info to them now that I think about it. Anyways They are contradicting themselves a lot in this report. Also I have come to find out that they shot the dogs with a 40 Caliber 9 mm Glock, and he was 2-3 feet away from the dogs so that makes it pretty much point blank. Now anyone who knows about guns, like I do, know that if you shoot something with a 40 Caliber bullet you are gonna do some serious damage, that is a lot of firepower. The offending officers name is officer BRIAN FRAYER #2128 of the East Palo Alto Police Department. That day he had a Police Explorer riding with him, Soria Gilberto both of there stories appear to have been rehearsed, becasue they are identical. After the shooting they found 3 shell casings and only 1 bullet. Where are the other bullets? Now that means that those bullets traveled somewhere other than the location of the shooting, which also means they could of hit one of my children while palying in the back yard, or anyone or anything else for that matter. Now I spoke with my uncle who is a Police Officer for Contra Costa County, he said basically there is nothing I can question other than WHY. WHY WAS THE OFFICER IN THE BACK YARD AT ALL? My uncle stated being an officer that he should not have been back there PERIOD!!!! Animal Control was on route, there was no need for the offcier to go in the back yard. The dogs were contained in a confined area between my yard and the neighbors yard. "Officer Frayer explained the dogs were so fast and aggressive; he didn't have time to defend himself from attack in any other way. He believes that if he hadn't shot the dogs that ran at him, he would of been attacked." Can we say BULL!

Investigating Officer R. May States:

I examined Geyser. He is a full grown male weighing apprx. 50 pounds. He had 3 bullet holes in his body and a fourth hole in his right forearm. I could feel a bullet in Geyser's elbow. I removed the bullet. The first dog, Geyser was shot twice. He had bullet holes in his chest, neck, and elbow. He died at the scene. One bullet entered the LEFT side of his chest and exited the right side. After exiting the chest, the projectile entered the right elbow. The second projectile entered the chest.

Now Officer Frayer's Statement of what happened when Geyser approached him: Officer Frayer could not see the corner of the fence or the hole from the rear door of the home. He entered the rear yard. There was a blue trash can appx. 12 ft. from the back door. As Officer Frayer reached the trash can he saw 2 dogs running at him from the back of the yard. He could hear either one or both dogs growling. Officer Frayer began to back towards the rear door of the house. He moved to his right, putting the blue trash can between himself and the dogs. The dogs continued running towards him, moeving around the trash container.

Offcier Frayer realized he couldn't make it back to the rear door of the house and feared for his safety. The lead dog, identified as Geyser, quickly reached Officer Frayer, with the second dog (Baloo) directly behind him. Officer Frayer believed he was about to be attacked because the dogs were running at him and he could hear growling. When Geyser was within two to three feet of Officer Frayer, he (officer frayer) fired once at him. Geyser jumped and continued toward officer Frayer. He fired a second shot at Geyser. Geyser immediately turned around and headed towards the back fence.

(Side note, I do not believe Geyser would get shot and still come at the officer that is bullshit these are 40 caliber bullets you shoot a 50lb dog with that they are gonna go flying at least 10-15 feet. Not to mention him running back to the rear fence would be suspicious. I believe this officer fired on both dogs and they were not approaching him, reason being geyser's wounds are to the left side of his body, if the dog was directly coming toward him don't you think the wounds would be placed somewhere other than his side.) Also I still believe Baloo was shot first.

Investigating Officer R. May: I examined Baloo. He is a full-grown male pitbull weighing apprx. 80 lbs. He had a single gunshot wound to his body and another to his neck. I could not tell which wound was the entrance wound and which wound was the exit. The second dog, Baloo was shot once. THere was a bullet hole in his neck and chest. He died at the scene. It appeared that the neck wound was the exit wound. (Side note, Baloo was facing my yard when I looked through the fence and saw his body, the positioning of the body in my opinion would conclude that Baloo was coming back to my yard when the offcier fired on him, if the bullet entered his chest and exited his neck this would make sense.)

Officer Frayer's statement of why he shot my boy: As Geyser turned Baloo ran around him in a circle, and headed straight for Officer Frayer. Officer Frayer shot once. Baloo turned toward the fence and collapsed. Officer Frayer noticed a third dog in the back of the yard (Louie). This dog was in the yard briefly and ran away when Officer Frayer fired the first shot. (Side noteI know Baloo was scared of things being pointed at him I know he was facing my yard because he had turned around to come back, I know this in my heart and can't no one tell me differently.)

Soria's Statement, Police Explorer: Sorai said Officer Frayer fired once and the dogs kept coming. After Officer Frayer fired a second time, the larger dog circled around the lead dog and ran at Officer Frayer. Soria saw Officer Frayer fire at the second dog as it reached him (officer frayer). Soria did not see the third dog.

So again I ask WHY? WHY was this Officer in the back yard to begin with? PLEASE EVERYONE HELP ME BY CALLING THE MAYOR'S OFFICE AND WRITING LETTERS TO THE MAYOR OF THE CITY. For those of you that knew of Baloo personally please help by writing letters in regards to his temperment and anything else you can think of. For those of you who were at the Antioch show to witness Geyser winning his Jr. Male class, please write. I will write my own very long letter to the mayor myself and copy and paste and send to you all once I have finished it. I am gonna put breed history in and history of my dogs I will document as well to the best of my ability. I am still very traumatized I can keep myself busy all day and try not to think of what Occured on that life changing day, but as soon as I lay down to sleep, this is the first thing that pops in my head, when I have nothing else to keep my mind from thinking about it, I can't sleep, I have since moved out of the neighborhood, I still have some big things to get out of the house. But for now I am concentrating on keeping Louie by my side and trying to help him get over it as well. Louie is traumatized he has a blank and sad expression most of the time, if I slightly yell at him or if he hears loud noises, he freaks out. I hope this incident has not ruined his temperment. I went down to the humane society to get some paperwork squared away and also to inform them that Louie no longer reisdes in their county, and the animal control officer that collected the bodies of my dogs was there, he asked how I was, etc. I told him I am OK, but that I had to move because if I can't trust my neighbors or the Police Department, Who can I trust? I told him also that I was trying to keep my last living dog alive...and he said oh you have him with you and then he leaned over the counter and called to Louie but Louie did not respond. He said wow, he is not all there, I explained yeah he is traumatized. Keep us still in your prayes and thoughts. We are still trying to see what we can do from a legal stand point. But for now I have decided with the help of all of you, you have my premission to copy and paste what you will, e-mail, post this along with my last e-mail, with heavy heart...inform as many people as you possibly can, the least that we can do at this point is raise a atink for this department, officer, and city.

It's very unfortunate about your animal companions. Having had a dog of my own, I understand the bond that can be shared between pet and pet owner.

However, I must say that as a responsible owner, I spent every possible moment ensuring that my dog was safe from any sort of harm. Part of those measures included checking the back yard for holes or ways to get out, checking for poisons in the back yard that he could eat, watching his diet. There are so many variables when it comes to protecting those closest to you. The simple fact that your animals were not on your property shows a significant amount of negligence.

Additionally, although dogs can be trained, they still have the inherent nature to be aggressive when it comes to the unfamiliar.

My point is that in order for things like this not to happen in the future, it is essential that the individual take all steps necessary to protect ourselves, our property, and each other from these sorts of unfortunate situations.

I am sorry that your dogs were killed, but ultimately the responsiblity here lies on you. If your dogs were secure in your yard, they would still be alive.

Yes this breed is discriminated against, but there is some truth to some of the myths. Not because of what the breed should be, but because of how they have been exploited. Pit bulls should not be human aggressive, but you know what? Due to irresponsible breeding, training and environment, there are a lot that are. I don't care about your dog's pedigree, I know of several "show" dogs that are human aggressive and several backyard bred pits that have excellent temperments.

Your dogs may be friendly around you, but you do not know how they act when you are not there, especially towards a uniformed police officer. Lots of dogs, regardless of breed, have issues with cops and other uniformed people.

I have pit bulls, I am very aware of their history and the plight that they suffer. Because of this reality I take steps to ensure that my dogs are never in a position where they could get into trouble.

Oh and just an fyi, Officer Frayer has met my pitbulls on more than one occassion and has always been friendly towards them. You cannot blame the police for being afraid, just try to educate them when you can and make sure you and your dogs are good representatives of the breed.

I can say I am sorry for your grief but in seeing so many pit bulls now in E.P.A. it does not make any sense to me..for the news stories it tells of so many pit bulls attacks for no reason on the victim I feel no pity for the dog..I see people riding around the school yards and streets when the kids get out of school like the dogs will not attack the kids with drool on the mouth watching kids its like they are waiting to attack the right kid./ The owner can not control the dog I have seen this on my own with attacks by pit bulls..I see them wondering out of their yard.walking up and down the streets.which means the owner has not seen to it that it can not get out..holes in fence..fence not lock..or dog can break down fence!!!!!..its up to the owner to keep dog inside yard!!!!!..Why are so many pit bulls in EPA now..Years ago they werent here or at lease not this many.They are dangerous dogs. that has been proven to attack their masters for no reason.!!!!!!!!!!!!!!

police officers are not animal killers they just need to shoot or some sort to rescue people if it where not for them we would have mean dogs running around the neighbor hood i dont think anyone would want that so police are not animal killer!!!!!!!!!!

Let me start by saying I am so sorry for your loss and that I can totally relate. The LAPD can to my residence for a disturbance call and approached the property with their guns drawn. My pitbull Duke and I were coming out of our house and he went first down the stairs heading up our driveway to a gate in the middle of the driveway that joins to our apartment building next door after locking the front door I followed him. When I got to the last three steps an officer was aiming his gun at my dog. Duke was frightened and turned around to run to me when the officer started shooting. One bullet went through his shoulder and when he didn't go down three bullets followed the second one paralized him severing his spinal cord. God only knows where the other 2 bullets went. They could have shot me. They left him lying there for almost 2 hours and said if I continued to help him and didn't step away from him they would put me in handcuffs. The SPCA finally came and got him and I had to put him down at the VET's office. Like you the hardest day of my life. For over a year I have been filing complaints with Internal Affairs, Justice Department, Senators, Congressmen, Govenors etc. Well the verdict came out 2 weeks ago no fault by the officer and that was decided January 17th but they waited until the end of March to notify me just beyond the statue of limitations to file criminal charges against the officer one year February 15, 2005. I am also horrified by the lies and the accounts they presented to the Police Commissioners. LIES ALL LIES. I am at a loss of what to do now. But I hope your fight is continuing. Remember the 1 year statue of limitations so it doesn't run out on you too. And as for the other comments made previously under no circumstances is it okay for an officer to use a gun as a means of protection from a dog pepper spray works just fine or a baton. A drunk guy hit my pitbull once with a motorcyle helmet and you never seen a dog run away and whimper so fast. What are the police afraid of a DOG BITE officers ride in pairs if it gets out of hand then the back up should shoot. Using a gun as the first option against a dog of any breed is absolutely obsurd. Don't they train these officer on how to deal with aggressive dogs????? But as you know in my case and yours the dogs were not even barking at them they used excessive force because they think they can get away with it. To them it was just a dog to you and me if was a member of our family just like shooting any other member of our family. If you were to shoot one of their dogs they treat it the same as killing a human. So why is there value of other dogs the opposite? I wish you luck in your fight stay strong and keep fighting no matter what lies they tell or how many people say it is your fault. IT IS NOT YOUR FAULT......IT IS THE POLICE'S FAULT FOR NOT TRAINING THEIR OFFICERS BETTER AND FOR ALLOWING THIS TO CONTINUE GOING ON LIKE THIS WITHOUT DOING SOMETHING ABOUT IT. And I am sure if this kind of thing happened to one of these other people dog's posting then they two could understand how wrong it is and who's fault it really is.

I have written a book called Preparing Yourself for Dog encounters, it has a section for Law Enforcement. If you want me to send it to a Law Enforcement agency free of charge please send me their address. We have to educate them to be able to read dog body language and options to use before deadly force is used and most importantly keep them safe in return we have to educate the community on keeping dogs under control. Your thinking why are you sending it free, well if they like the book I can come in and give a class. The class is three hours long and will cover every topic you can think of about dogs and aggression. Spread the word to give officers confidence when confronting dogs. i am the owner of two rottweilers both over 110 lbs.ive lived where im at 15 years. i love my dogs like they were my children.i have a 5ft fence thats electric at the top and bottom.the gates are galvanized steel.my neighbor has kids that pass my house every day going to school. the dogs meet them at the fence.would they bite one of them? probably so if they came in the yard unattended.would they bite one if they got out of the yard? i would like to think not but then im not the one doing the thinking the dog is. i hope my neighbor calls me but the fact is that he doesnt like them so thats not gonna happen.knowing that..before my dog assaults anyone ecspecially a child i hope he calls the police.if i was a cop and im not..i would not wait till a 121 lb rottweiler grabs hold to my arm or neck and then decide if he is violent or not.in short..keep your dog in your yard.

many times the so called "peace officers" are just as bad or worse than the criminals they are sworn to protect taxpayers from.
